Terms of Service

The Service

Tream provides 8 interactive games (Tug of War, Live Trivia, Nitro Race, Voting Arena, Lucky Wheel, Ticket Printer, Love Calculator, Word Puzzle) that a host displays during a TikTok LIVE and that viewers play by posting comments. Features include per-game settings, custom trivia and word packs, stream view and a demo mode with simulated comments. We may add, change or remove games and features over time.

Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract to create an account or purchase a subscription. You must also meet TikTok’s own requirements for hosting a LIVE.

Your account

You are responsible for the accuracy of your account information, for keeping your sign-in credentials secure, and for all activity under your account. You may only connect a TikTok username that you own or are authorised to use. Tell us right away at [email protected] if you suspect unauthorised access.

Relationship with TikTok

Tream is an independent product and is not affiliated with, endorsed by, or sponsored by TikTok or ByteDance. Your use of TikTok is governed by TikTok’s terms and community guidelines, which you are responsible for following. TikTok may change its platform, features or access to live data at any time, which may affect how the Service works; we are not responsible for TikTok’s actions or availability.

Free trial

New accounts may receive a free trial. The trial is currently 3 days; the length is set by Tream and may change for future signups, but your trial keeps the end date you were given. One free trial is allowed per person. When the trial ends, you need an active paid subscription to keep opening games. You can browse your home screen without a subscription.

Subscriptions, billing and renewal

• Plans and prices. Current plans and prices are listed on our pricing page and shown at checkout, in USD unless stated otherwise. Taxes such as VAT or sales tax may be added depending on your location.
• Payment. Payments are processed by Stripe. By subscribing, you authorise us (through Stripe) to charge your payment method for the subscription fee and applicable taxes.
• Automatic renewal. Subscriptions renew automatically at the end of each billing period (monthly or yearly) at the then-current price until you cancel.
• Price changes. We may change subscription prices. We will give you reasonable advance notice by email, and the new price applies from your next renewal after the notice. If you don’t agree, you can cancel before the renewal.
• Failed payments. If a payment fails, Stripe may retry it. We may suspend access to games until payment succeeds.
• Invoices. Receipts and invoices are available in the Stripe customer portal from the Billing page.

Cancellation and refunds

You can cancel at any time from the Billing page in the app, which opens the Stripe customer portal. Cancellation stops future renewals; you keep access until the end of the period you already paid for. Refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms.

Acceptable use

You agree not to use the Service to:

• break TikTok’s terms or community guidelines, or any law;
• harass, threaten, defame or discriminate against anyone, or display hateful, sexual, violent or otherwise illegal content in games, packs or images;
• run gambling, lotteries or games of chance for money or prizes of monetary value where that is unlawful;
• disrupt someone else’s LIVE, connect to a LIVE you don’t own or have permission to use, or impersonate others;
• access another host’s account, games or billing, probe or overload our systems, or reverse engineer, scrape or resell the Service.

We may suspend or terminate access that puts the Service, our users or other people at risk.

Your content

You keep ownership of content you create or upload, such as question packs, keywords and images (“Your Content”). You grant Tream a worldwide, non-exclusive, royalty-free licence to host, store, process and display Your Content only as needed to operate the Service for you. You confirm that you have the rights to Your Content and that it does not infringe anyone else’s rights. Viewer comments displayed by the games belong to the people who wrote them.

Our intellectual property

The Service, including its games, graphics, code and branding, is owned by Tream and protected by intellectual property laws. Subject to these Terms and an active trial or subscription, we grant you a personal, non-transferable, non-exclusive licence to use the Service and to show the games on your own live streams, including in recordings and clips of those streams.

Availability and changes

We aim to keep the Service available but do not guarantee it will be uninterrupted or error-free. We may suspend the Service for maintenance or security. Games, limits and these Terms can change. If a change to these Terms is material, we will update the date above and notify you by email or in the app. Continuing to use Tream after a change takes effect means you accept the updated Terms.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you materially breach these Terms, fail to pay, or use the Service in a way that could cause harm or legal liability. If we terminate your account without cause, we will refund any prepaid fees for the unused part of your subscription.

Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any particular results on TikTok, such as more viewers, followers, gifts or income.

Limitation of liability

To the maximum extent permitted by law, Tream will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, or your statutory rights as a consumer.

Indemnity

You agree to indemnify and hold Tream harmless from claims, losses and expenses (including reasonable legal fees) arising from Your Content, your live streams, or your breach of these Terms or of TikTok’s terms.

Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which Tream is established, without regard to conflict-of-law rules. Before filing a claim, please contact us at [email protected] so we can try to resolve the dispute informally. If you are a consumer, you also benefit from any mandatory protections of the law of the country where you live, and you may bring proceedings in your local courts.

General

These Terms, together with the Privacy Policy and Refund & Cancellation Policy, are the entire agreement between you and us about the Service. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of assets.
